8. Litigation

This contract shall be governed by French law. Domaine Isle Saint Pierre cannot be held liable for damages of any kind—whether property, immaterial or bodily—resulting from improper operation or misuse of products sold. The same applies to any changes to products made by manufacturers. In any event, Domaine Isle Saint Pierre’s liability shall be limited to the amount of the order and shall not apply to simple errors or omissions that may take place despite all precautions taken in the presentation of products. In case of difficulties in the application of this contract, the buyer may, before introducing any legal action, seek an amicable solution including with the help of a professional association of the industry, a consumer association, or any other counsel of their choice. Buyers are reminded that the search for an amicable solution does not interrupt the legal guarantee “short time”, nor the duration of the contractual guarantee, and that as a general rule and subject to Court discretion, compliance with the provisions of this contract relating to contractual guarantee supposes that the buyer honours their financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer should first contact the company to reach an amicable solution.

Failing this, the Tarascon Commercial Court shall be the only competent court, whatever the place of delivery and the method of payment accepted.

Under Articles L 611-1 and R 612-1 et seq. of the French Consumer Code on amicable settlement of disputes: Where the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, they may submit their complaint free of charge to the consumer mediator (ombudsman). The matter must be referred to the mediator within maximum one year from the initial complaint.

The MEDIATION-NET mediator can be referred to directly online on: www.mediation-net-consommation.com, or by mail to: MEDIATION-NET Consommation – 34 Rue des Épinettes – 75017 PARIS

In no circumstances shall Domaine Isle Saint Pierre be held liable for non-compliance with regulations and laws in force in the country of reception, Domaine Isle Saint Pierre’s liability being systematically limited to the value of the relevant product at the date of sale and without recourse to the brand or company producing the product.

In any event, the customer shall benefit from the legal covenant for peaceful possession and guarantee against latent defects (Art.1625 et seq. of the Civil Code). On condition that the buyer proves the hidden defect, the seller shall legally repair all consequences (Art.1641 et seq. of the Civil Code); where the buyer goes to court, they shall do so within “short time” as of the discovery of the hidden defect (Art.1648 of the Civil Code).
